Such people, however, risk being intercepted by immigration officers where they are considered as aliens and proceed to be detained. The law, however, allows one to be released through the payment of a bond set by the immigration department.
Immigration officers are allowed by the law to set the bond amounts for the detained aliens. If this is set, the detainee can have a responsible person pay the bond on their behalf. The person undertaking the process in this regard has approximately one week to ensure the bond payment process is done.
If it happens that the aliens are denied the bond, the matter can be brought to the floor of the courts. Payments for the bond granted needs to be done by a legal citizen of the US as per the laws of the land. A day is scheduled for the payments through an appointment and the process requires this to be made to the immigration officers. There us a requirement, however, to make the payments in a personal check as there is no option of making the payments in cash. Alternatively a cashier’s check can be written to be paid to the department of homeland security. The US immigration bonds and insurance services also offer assistance in the payment of the bonds.
A clearance is given once the full amounts set for the bond are paid and it is at this point that the alien can be released. A fast process is in place where one only requires at least an hour to have the whole process completed. With the clearance, the person paying the bond is required to pick the detained lien from the facility where they are held. Communication is made to ascertain the clearance and the detaining facility then releases the alien.
The alien is required to seek legal aid immediately after the release. This is to ensure the individual gets cleared from any instance that makes them be considered as aliens. In the instance where the alien is detained in a far location, one is required to contact the local offices to have the process facilitated.
